Abstract

The effectiveness of Transitional Justice undoubtedly depends on the work of the Memory and Truth Commissions. However, are these commissions really an effective mechanism for the implementation of transitional justice? Or are these Commissions only representative of a formal institute to meet the formalities of the need for the Brazilian State to act, by virtue of its condemnation by the Inter-American Court of Human Rights in the Araguaia Guerrilla case? The present research work will seek to answer these questions, with a special focus on the performance of the state truth commissions, with the systematization of the recommendations made, especially those that presented a final report, until the completion of this research, in 2015, the truth commissions of the states of São Paulo, Rio de Janeiro, Rio Grande do Sul, Santa Catarina and Paraná. From this analysis, it will be possible to examine the effective contribution of the commissions at the level of the subnational protection of the fundamental right to memory and truth.
