Crise da governança global em saúde: Covid-19 e seus impactos à saúde global

A Organização Mundial da Saúde (OMS) pretende ser a autoridade central da governança global da saúde. Dotada de poderes sem precedentes para a elaboração de convenções e regulamentos com força vinculativa aos seus Estados-membros, a Organização, ao longo dos seus 75 anos de história, desenvolveu apenas três tratados internacionais. Este ensaio busca analisar um deles: o Regulamento Sanitário Internacional (RSI), instrumento que busca proteger, controlar e dar uma resposta a propagação internacional de doenças. Este regulamento, no entanto, foi sistematicamente violado pelos Estados-membros da OMS durante a pandemia da Covid-19, evidenciando a crise da governança global em saúde da Organização Mundial da Saúde. Esse ensaio divide-se em três partes. Na primeira, busco explorar o entendimento de que o medo e a insegurança ocasionados pela Covid-19 não são um fenômeno novo dentro do cenário internacional; na segunda parte deste ensaio, discorre-se sobre a posição que a OMS ocupa no cenário internacional, bem como os seus poderes constitucionais para a governança da saúde global; na última parte deste ensaio, analisa-se o RSI e as violações perpetradas pelos Estados-membros à Organização Mundial da Saúde e o Regulamento de força vinculativa. O trabalho fecha apontando os possíveis desafios em um mundo pós-Covid.
