Abstract

This text presents a review of the book ‘Separação dos poderes na modernidade: uma releitura sistêmica’, by Fernando Rister de Sousa Lima and Orlando Villas Bôas Filho. As the authors state in the introduction, the objective of the research is to outline a systemic analysis of the separation of powers in the context of contemporary society, marked by fragmentation into several autonomous systems, which perform distinct functions in a hypercomplex universe. To this end, it draws on Niklas Luhmann’s systems theory, which, as demonstrated in the book, is highly consistent with the analytical proposal put forward. The book’s revival is in line with the current demand to expand the possibilities for understanding the separation of powers. In many places, the tensions inherent in the tripartite model often seem to exceed the limits once imagined. Books such as these stimulate the imagination, contributing to the search for solutions. Once again, the potential of legal sociology to address sensitive issues has been demonstrated.
