CRIATIVIDADE E DESCISÃO JUDICIAL: CONSIDERAÇÕES A PARTIR DO PRAGMATISMO JURÍDICO DE OLIVER WENDELL HOLMES JR. E DA FILOSOFIA VITALISTA DE HENRI BERGSON
Resumo
O presente artigo pretende abordar a relação entre criatividade e decisão judicial sob a perspectiva de duas abordagens filosóficas distintas, porém que guardam certa proximidade: o chamado pragmatismo jurídico de Oliver Wendell Holmes Jr e a filosofia de Henri Bergson. O nosso objetivo é destacar como os dois autores fornecem elementos para repensarmos a criatividade na decisão judicial como inerente. Tomando como ponto de partida a abordagem realista, mas também pragmática, de Holmes, nós observamos como a construção das teorias e conceitos jurídicos ocorre retrospectivamente, ou seja, após a resolução dos vários casos que compõem a história institucional de um sistema jurídico particular. A criação é pensada neste ponto em termos de experiência circunstancial, histórica e particular. Por fim, desenvolvemos uma leitura específica Bergson com o intuito de associarmos essa noção de experiência à própria evolução concebida em termos de diferenciação e criação de categorias através da resolução de problemas.
